Federal Judge Mandates Release of Abrego Garcia from Immigration Detention
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.
The case originates in a erroneous deportation to El Salvador in March, which the government later admitted was an mistake. Following his repatriation to the United States to face human smuggling allegations, he was detained in immigration detention.
In her order, the court noted that the government lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
